Agreement to Terms and Conditions:
This agreement is between you and Empower and Engage (“Company” or “We”). By enrolling in
Five Steps to Building your Child’s Confidence
(the “Course”), you (“Participant”) agree to abide by these Terms and Conditions. Your access to and participation in the Course signifies your understanding and acceptance of these Terms and Conditions.
2.
No Assignment:
Enrollment in the Course is personal to Participant and is non-assignable and non-transferrable.
3.
Course Enrollment and Payment: Enrollment in the Course requires payment in full, unless specified otherwise. Once payment is received, you will receive access to the Course materials for the duration outlined at the time of purchase. Refunds, if offered, will be processed according to our Course Guarantee (see Section 4).
4.
Course Satisfaction Guarantee:
If Participant is not satisfied with the content of the Course, then Participant may request a refund under this Course Satisfaction Guarantee subject to the following limitations:
a)
Participant must request the refund within the first seven (7) days of the Course. After seven (7) days, or if more than three (3) sessions of the Course have been accessed by Participant, Participant will not be eligible for a refund.
b)
Participant must have followed the recommendations outlined in the Course materials, including but not limited to, viewing up to three (3) pre-recorded Course sessions; completing the recommended weekly homework; and sharing within the community Facebook group.
c)
All refund requests must be submitted through the submission of
THIS FORM. The refund request shall summarize the Participant’s activity within the Course through the date of the refund request and provide the reasons for Participant’s dissatisfaction with the Course.
d)
Upon receiving a valid refund request, Company will review the request and respond within five (5) business days. If approved, a refund will be processed to Participant via PayPal within seven (7) business days of the request.
e)
This Course Satisfaction Guarantee does not apply to dissatisfaction resulting from factors outside Company’s control, such as changes in Participant’s circumstances or availability, or actions of or content posted by third party participants involved in the Course.
Company reserves the right to determine the validity of refund requests.
5.
Intellectual Property:
All content in this Course, including but not limited to text, images, videos, and worksheets, are the intellectual property of the Company. Participants are granted a limited, non-exclusive license to access and use these materials solely for personal, non-commercial purposes. Any reproduction, distribution, or resale of Course content without prior written permission from the Company is strictly prohibited.
6.
Course Access:
Participants will receive access to the Course through an online portal. Group Zoom meetings and one-on-one calls are available to Participants for the entire Course term of 45 days, as shown by the countdown clock located on the Course dashboard. Participants will continue to have access to other resources available on the online portal for a limited period of time after completion of the Course. Access is limited to the Participant and may not be shared with others. The Company reserves the right to revoke access without refund if the terms of access are violated.
7.
Code of Conduct:
Participants are expected to engage respectfully within the Course community. Harassment, offensive language, or disruptive behavior will not be tolerated and may result in immediate removal from the Course without refund.
8.
Disclaimer and Limitation of Liability:
The Company makes no guarantees regarding the outcome of participating in this Course. The Course is designed for educational purposes, and any results are dependent on individual effort and personal application. The Company is not liable for any direct or indirect damages arising from your participation in the Course.
9.
Privacy Policy: We respect your privacy. Your personal information, collected during enrollment and participation, will be used solely for Course-related purposes and will not be shared with third parties without consent.
10.
Modification of Terms:
The Company reserves the right to update these Terms and Conditions at any time. Participants will be notified of significant changes, and continued participation in the Course after modifications indicates acceptance of the revised terms. Any such change may also be published on Instructor’s website or social media.
11.
Disputes:
In the event litigation arises out of these Terms and Conditions, the prevailing party is entitled to all legal costs, expenses, and reasonable attorneys’ fees and costs. The court shall not be bound to award fees based on any set, court fee schedule but shall if it so chooses, the court may award the true amount of all costs, expenses, and attorneys’ fees paid or incurred. In no event shall the Company be liable for exemplary, punitive, indirect, special, incidental, or consequential damages.
12.
Governing Law:
These Terms and Conditions are governed by the laws of the state of Washington. Any disputes arising from these terms or participation in the course shall be resolved within the jurisdiction of Spokane County, Washington.
13.
Binding Agreement:
These Terms and Conditions shall be binding upon and for the benefit of the heirs, personal representatives, successors and assigns of the parties.
